Is it legal to solicit for donations for writing fan fiction stories?

I came across a fan fiction writer that is soliciting for donations directly related to her writing of copyrighted fan fiction stories. We all know that fan fiction is written by people using material and characters related to these copyrighted franchises and not receiving or charging money for their efforts, but I have never in 10 years seen anyone actually solicit for donations. (Until NOW) So I was just wondering if this FF writer could get into trouble for this? Or perhaps even cause big trouble for Fan fiction in general?

The matter has been resolved now. The Author in question has removed references to donations from her Fan Fiction bio/profile page and donation comments from some Author notes after several chapters. CASE CLOSED.

The furthest it’s acceptable to go is if you share your stories in printed form you can ask for the _exact cost_ of postage and photocopying. Not something close to it, with a bit more for your time and trouble. Not “donations towards”. The postage cost plus the photocopying cost per page multiplied by the page number.

It’s definitely illegal to do that, since fan fiction writers don’t own the copyright for the stories they’re writing. The only “payment” fanfiction writers are supposed to receive are reviews. That fanfiction could (and most likely will) get into trouble, and will probably cause trouble for fanfiction in general. A lot of authors say that they’re flattered by fanfiction, but it’s not going to stay that way if they find out that someone’s making money out of their franchises.

Illegal, as is writing the fanfic in the first place. The rights owners pay no attention until it starts being a money-making thing, at which point they are likely to demand all profits, even if they have to sue to get them. They will win.

Have you considered alerting the website owners and/or the rights holder? It’s much better to be ignored by, or tolerated with amusement by, the rights owner rather than shut down or sued by them. This impacts everybody whose fanfic is posted at the site, which could easily be shut down without notice as soon as the attorneys representing the rights owner contact them.
